Welcome to ChoreHero. These Terms of Service ("Terms") govern your use of the ChoreHero mobile application and services (the "Service"), operated by ChoreHero, a Georgia limited liability company (in formation) ("ChoreHero," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What ChoreHero Is

ChoreHero is a marketplace that connects people who need home and local services ("Customers") with independent service providers ("Heroes" or "Pros"). Customers post jobs, Heroes send short video quotes, and Customers book the Hero they choose. ChoreHero facilitates discovery, booking, communication, and payment.

ChoreHero is not a cleaning, home services, or labor company. We do not employ Heroes, perform services, or supervise the work. We provide the platform that connects the two sides and processes payment.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use ChoreHero. By using the Service, you represent that you meet these requirements. ChoreHero is currently available only in designated service areas within the United States.

3. Accounts

You are responsible for the accuracy of your account information and for keeping your login credentials secure. You are responsible for all activity under your account. Notify us immediately at hello@choreheroapp.com if you suspect unauthorized use.

4. Independent Contractor Relationship

Heroes are independent contractors, not employees, agents, partners, or joint venturers of ChoreHero. Heroes set their own rates, choose which jobs to accept, control how and when they perform their work, and use their own tools and supplies. Nothing in these Terms creates an employment relationship.

Heroes are solely responsible for their own taxes, including self-employment tax. ChoreHero may issue tax forms (such as a 1099-NEC) where required by law, but does not withhold taxes on a Hero's behalf.

5. Verification and Background Checks

Before a Hero can accept bookings, ChoreHero requires identity verification, conducted through third-party providers (currently Stripe). Some service categories additionally require a background check (through Checkr) or proof of insurance before a Hero can offer them; a Hero's profile shows a background-check badge only when one has actually been completed. A one-time verification fee applies, which may be refunded after a Hero completes a set number of jobs as described at sign-up.

Verification is not a guarantee. A background check reflects available records at a point in time and does not guarantee a Hero's conduct, reliability, or safety. Customers are responsible for using their own judgment when allowing any person into their home.

6. Bookings, Payments, and Fees

Customers pay the price shown at checkout. ChoreHero charges Heroes a flat commission on completed bookings; the commission is deducted from the Hero's payout and is not added to the Customer's price. The current commission rate is disclosed in the app and may change with notice.

Payments are processed by Stripe. By using the Service, you also agree to the Stripe Services Agreement. Heroes who receive payouts are additionally subject to the Stripe Connected Account Agreement. ChoreHero holds Customer payment until a job is completed, then releases the Hero's earnings according to our payout schedule.

All booking and payment activity must stay on ChoreHero. Arranging payment or services off-platform to avoid fees is a violation of these Terms and may result in account suspension.

7. Cancellations and Refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy, incorporated into these Terms by reference. In summary: if a Hero cancels or fails to show, the Customer receives a full refund. Quality concerns are subject to a reporting window and review.

8. Conduct

You agree not to: misuse the Service; harass, threaten, or discriminate against any user; post false, misleading, or unlawful content; attempt to circumvent fees or take transactions off-platform; share another person's private information; or use the Service for any unlawful purpose. ChoreHero may remove content or suspend accounts that violate these Terms or our Community Guidelines.

9. Content You Provide

You retain ownership of content you submit (such as video quotes, photos, and reviews). You grant ChoreHero a non-exclusive, worldwide, royalty-free license to host, display, and use that content to operate and promote the Service. You are responsible for ensuring you have the rights to any content you upload.

10. Third-Party Services

ChoreHero relies on third parties including Stripe (payments and identity), Checkr (background checks), and cloud and video infrastructure providers. Your use of the Service may be subject to their terms, and ChoreHero is not responsible for their acts or omissions.

11. Disclaimers, Limitation of Liability, and Indemnification

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. ChoreHero does not warrant the quality, safety, or legality of services provided by Heroes, the truth of any listing, or that the Service will be uninterrupted or error-free.

To the fullest extent permitted by law, ChoreHero is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any damages arising from the acts or omissions of Heroes or Customers. Because services are performed by independent Heroes in Customers' homes, you agree that disputes about the services themselves are primarily between the Customer and the Hero.

You agree to indemnify and hold harmless ChoreHero from claims arising out of your use of the Service, your content, or your violation of these Terms.

12. Suspension and Termination

ChoreHero may suspend or terminate your access at any time for violation of these Terms or to protect the Service and its users. You may close your account at any time.

13. Changes to These Terms

We may update these Terms. The current version is always available in the app with its version number and effective date. Material changes will be communicated in the app. Continued use after changes means you accept the updated Terms.
